Terms and Conditions

Thank you for visiting the EdIT website. Your privacy is very important to us. Simply stated, we do not collect personal information about you when you visit our website unless you choose to make such information available to us. When you visit the EdIT site, the University’s web server automatically recognizes only the internet domain and IP address from which you accessed the site. This information does not result in the identification of your personal email address or other personal information. In addition, information is only gathered regarding the volume and timing of access to the site by collecting information on the date, time and pages you visited while at the site. This is done so that the content of the site can be improved, and your personal information is not identified or shared with other organizations. If you choose to share personal information with us, such as by subscribing to an e-newsletter, sending a message, or filling out an electronic form with personal information, the information will be saved for a designated period of time in order to comply with the state of Florida’s archiving policies. However, the information will not be disclosed to third parties or other government agencies, unless required by state or federal law. Please note that Florida’s public records law requires that all information received in connection with state business be made available to anyone upon request unless the information is subject to a specific statutory exemption. If you do not want your email address disclosed as a public record, please contact FIU via telephone or by U.S. mail. Terms and Conditions

  1. Participant, when making an application to participate, accepts and agrees to comply with the conditions of this contract governing the conduct of and participation in the conference. Participant further agrees that this contract is binding on a parties and can be amended only in writing by both parties hereto.
  2. The registration fee must be paid in full on or before the first day of the event. Payments are accepted by: Credit or Check Card (No Cash or Personal Checks will be accepted). The registration fee is nonrefundable and non-transferrable.
  3. Participant who is also a sponsor (hereinafter – Sponsor) agrees not to assign or sublet any portion of any include space nor permit individuals other than employees and/or their representatives to use the facilities provided. Sponsor further agrees not to display products or literature that are not regularly sold or distributed to him/her, except as may be necessary to illustrate the applications of his/her product.
  4. FIU assumes no responsibility or liability for any theft, damage or loss by any cause of property to Participant, its employees or agents (if applicable), nor for any injury that may occur to Participant, its employees or agents (if applicable).
  5. Participant agrees to indemnify and hold FIU harmless and to reimburse the same for any judgments, settlements, costs or other expenses (including legal fees) to which it may be subject, for any injury damage, loss or harm resulting or occurring to anyone (including visitors) which may result directly or indirectly from or in connection with Participant, its employees or agents (if applicable) or by Participant, its employees or representatives (if applicable).
  6. FIU will not be liable for fulfillment of this contract due to any of the following causes: by reason of the building being destroyed by fire, natural event acts of God, strikes, and the authority of the law or for any other causes beyond FIU's control. FIU will hold all event activities as scheduled during times of inclement weather. FIU will not honor requests for refunds or credits for Participants who choose not to participate.
  7. Advertising/promotions are at the discretion of FIU. FIU reserves the right to reject, in whole or any part and at any time, any individual or material which in its which its opinions are objectionable to Participants or others. No liabilities or damages whatsoever against FIU or any of their representatives, agents or members shall be incurred because of such rejections. FIU shall have the limited right to use Sponsor’s trademarks and logos (Sponsor’s Marks), as provided to FIU by Sponsor’s Marks on a royalty-free basis for the exclusive purpose of implementing the various sponsorship benefits set forth in the contract such as providing Sponsor with logo recognition on certain event-related materials. FIU will not use Sponsor’s Marks for any purpose other than those set forth in the contract.
  8. FIU does not endorse or recommend the use of any specific commercial product or services. The Sponsor may not, therefore, imply either verbally or in printed literature, that his/ her products or services are approved, endorsed or recommended by FIU by virtue of this contract.
  9. Participant agrees to comply with all applicable laws, rules and regulations, specifically including, but not limited to, any local lire and safety regulations, and shall obtain and furnish any permits required.
  10. FIU reserves the right to cancel or change the date of any component of the event at any time.
  11. FIU is not liable for the acts of third parties or the consequences of the acts of third parties. These obligations shall survive the expiration or earlier termination of the contract.
  12. Participants who fail to comply with the security requirements may be denied access to the selected site by the hosting agency and/or FIU. FIU will not be responsible and will not provide refunds or credits to Participants who are denied admission to the event she due to failure to comply with these security instructions.
  13. FIU will coordinate all of the administrative, catering, purchasing of materials and other details dealing with the contracted Sponsor item (if applicable).
  14. FIU is subject to applicable public records laws as provided by provisions of Florida Statutes Chapter. The contract and any related documents and/or correspondences Participants submit to FIU shall become a public record subject to the Public Records law.
  15. The contract shall be construed and governed in accordance with the laws of the State of Florida and any disputes arising hereunder shall be resolved in the state courts located in Miami Dade County Florida. Nothing shall be construed as FIU's indemnification of Participant or as a waiver of sovereign immunity.
  16. The contract sets forth the entire understanding between the parties and supersedes all prior agreements, arrangements, and communications, whether oral or written, with respect to the subject matter hereof. The contract may be signed electronically and such electronic signatures shall be deemed an original for all purposes. The parties represent and warrant that any person signing the contract has the authority to do so and that such signature shall be sufficient to bind the respective party under the contract. The contract may be executed in counterparts. Facsimile signatures hereon shall be deemed original for all purposes. In the event that any provision of the contract shall for any reason be held to be invalid, illegal or unenforceable in any jurisdiction, such provision shall be ineffective as to such jurisdiction solely to the extent necessary to render such provisions valid, legal and enforceable, and without invalidating or affecting the remaining provisions hereof or affecting the validity, legality or enforceability of such provisions in any other jurisdiction.
